From what I know, it isn't. I'm pretty sure the LAW wasn't passed to ban tobacco commercials from TV. I think it was just an agreement by the people who control what appears on TV to stop showing anything that promotes tobacco. I might have a few details messed up, but that is what I heard on Discovery channel.

It sounds like that place is indirectly advertising their cigars. You can't advertise for a Marlboro menthol, but you can get away with advertising a shop. Although i haven't saw the commercial, it sounds like their beating around the bush so they can get away in court with it.

it is illegal to advertize cigs.cigars, ect on tv. Its not illegal to advertise a place that sells cigars ect
