Not true, at least in my school. The staff has the right to search you and you're possessions for the safety of the school. I don't see why they'd need to go through pictures, but regular texts could lead to a bomb plot or a shooting plan or something, which I guess is a big excuse.

^ Agree because right when you go to school your 4th ammendment is taken away. which guards against unreasonable searches and seizures.

They can't go through your phone though, at least the regular staff can't. Whenever they search people at my school a cop always has to do it, I don't think teachers are allowed to perform searches.

I know there was something that happened in either my school or a differant school in PA there was something that happened regarding the search of a purse. They caught a girl smoking a cig in the bathroom, and the school director dumped her purse on the desk and there was marijauna. She was expelled and her parents said it wasn't a legal search, and it was taken to court. I don't know how high up it went, but it should have gone to Supreme Court because that is about the ammendments? But anyway, the search was legal because of safety threats or something extremely stupid, almost as stupid as someone can sue you if they hurt themselves on your property. It turned out it was legal search, girl was expelled, my point is that I know some searches are legal. Now I know a phone isn't a purse, but I'm showing that you can definately be searched. I think that if the school had a no phone policy and it went off in class the school can confiscate it, but there doesn't seem to be any logical excuse to search it. I beleive that them searching should be stopped, and the charges of "sexting" should be differant from those of child pornography. No spellcheck on this computer, damnn. But depending on how far this issue went in court, I guess it could just be a PA thing.

for the school to search your things they need PROOF that you have something illegal.if your getting searched stop them and ask why. if they dont give a valid reason they cant fuckk with you. that girl was smoking in the bathroom and they had a right to go into her purse because chances are she had more cigarettes and that illegal for anyone under 18. she happened to have marijuana in her purse. she couldnt do anything to stop the search so she got fucked. i have been searched because the school believed i had marijuana on me. and they were 100% correct and i couldnt do shit about that because they had a valid reason. they have gone through my phone multiple times and that i have been able to stop because they never gave me a valid reason. you just gotta be smart and know the laws. chances are evan if your doing something illegal you can use the law to get away with it. and in some cases they will create false accusations just to search you. in which case you can try and rule out if you have not been doing that. and if you really know your shit you can get away with alot of things.

Schools sure as hell can confiscate your phone, hell my school charges 15 bucks for you to get it back if they confiscate it. I remember some story about a school charging 20 ended up on digg with people OUTRAGED and I was just like wtf haha it's so normal here.

Now, they cannot search your phone unless they have probable cause.

They make your parents come get it after school. If they ever tried to take it from me i would take my battery and SIM out.

My composition professor says if your phone is visible or rings during class she takes it for the rest of class, she can blow me, you can do whatever you want in class in college.
